Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CrewPool platform, website, mobile application, and related services (collectively, the “Platform”) operated by [company legal name] (“CrewPool”, “we”, “us”, or “our”).

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About the Platform

CrewPool is a digital platform that enables users to post, discover, and connect regarding construction-related resources, including but not limited to manpower availability, subcontracting needs, equipment, materials, transportation, and accommodation-related information.

Unless expressly stated otherwise in writing, CrewPool acts only as a technology and information platform. CrewPool is not a party to any employment contract, subcontract, tenancy, lease, licence, payroll arrangement, or other offline transaction or arrangement between users.

CrewPool is not, by default, an employer, main contractor, subcontractor, labour supplier, dormitory operator, landlord, property agent, or licensed employment agency.

2. Eligibility

You may use the Platform only if:

a. you are at least 18 years old;
b. you are using the Platform either in your personal capacity or on behalf of a legally registered business or organisation;
c. if you act on behalf of a business or organisation, you are authorised to do so;
d. you are legally permitted to engage in the activities described in your listings, requests, or transactions; and
e. the information you provide to us is true, accurate, current, and complete.

We may require you to provide supporting information for verification, including your name, contact details, company name, UEN, or any other information reasonably requested by us.

3. Business Accounts and Personal Accounts

You are responsible for:

a. maintaining the confidentiality of your login credentials;
b. all activity conducted through your account;
c. ensuring that only authorised persons use your account; and
d. notifying us promptly at [support email] if you suspect any unauthorised access or security incident.

You must not share accounts in a misleading manner, impersonate another person or entity, or create accounts using false information.

If you create or use an account on behalf of a business or organisation, you represent that you have authority to bind that business or organisation to these Terms.

4. Listings and User Content

You may submit listings, requests, descriptions, photographs, pricing, contact details, and other materials through the Platform (“User Content”).

You are solely responsible for your User Content and represent and warrant that:

a. you own it or have all rights necessary to use and publish it;
b. it is accurate, lawful, not misleading, and not fraudulent;
c. it does not infringe any third-party rights; and
d. it complies with all applicable laws, regulations, licence conditions, permit conditions, and industry requirements.

You grant CrewPool a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display, and distribute your User Content as reasonably necessary to operate, improve, secure, promote, and support the Platform.

We may, but are not obliged to, review, refuse, edit, suspend, restrict, or remove any listing or User Content at our discretion.

5. User Responsibilities and Compliance

You are solely responsible for ensuring that your use of the Platform and any transaction, deployment, arrangement, or listing arising from it complies with all applicable laws and regulatory requirements in Singapore and elsewhere where relevant.

This includes, without limitation:

a. employment and work pass laws;
b. workplace safety and health requirements;
c. accommodation and occupancy rules;
d. licensing, immigration, levy, payroll, tax, insurance, and contractual requirements;
e. property use restrictions, landlord consent requirements, zoning rules, and housing rules; and
f. all requirements issued by the Ministry of Manpower (“MOM”), Building and Construction Authority (“BCA”), Urban Redevelopment Authority (“URA”), Housing & Development Board (“HDB”), Singapore Civil Defence Force (“SCDF”), police, or any other relevant authority.

You are solely responsible for carrying out your own checks, including verification of identity, legal status, licences, training records, work eligibility, insurance coverage, accommodation approvals, bed capacity, and fitness for purpose.

6. No Employment Agency or Placement Services

CrewPool does not represent that the Platform is a licensed employment agency service.

You acknowledge that organisations or individuals who place job seekers with employers may require an employment agency licence under Singapore law. You are solely responsible for ensuring that your conduct on or through the Platform does not require you or CrewPool to hold any licence unless such licence is expressly stated to apply. If your intended use may amount to regulated placement, recruitment, referral, deployment, or staffing activity, you must obtain your own legal advice before using the Platform for that purpose.

CrewPool may restrict or prohibit any workflow or listing type that, in our view, may create regulatory risk.

7. Accommodation and Address-Related Listings

If you post any accommodation-related listing, you represent and warrant that:

a. the accommodation may lawfully be used for the stated purpose;
b. the stated occupancy, bedspace, duration, registration status, and permissions are accurate;
c. all required approvals, consents, and registrations have been obtained; and
d. the accommodation complies with all applicable legal and regulatory requirements.

You must not post any false, misleading, or outdated information about bed availability, occupancy capacity, work-pass-holder accommodation, or worker address registration.

Where applicable, employers remain responsible for properly registering and updating worker residential addresses and mobile numbers through the relevant MOM processes, including the Online Foreign Worker Address Service (OFWAS), and for ensuring the accuracy of such information.

8. Prohibited Conduct

You must not:

a. post false, misleading, deceptive, or incomplete listings;
b. post non-existent workers, fake vacancies, fake bedspace, fake equipment, or sham opportunities;
c. use the Platform for unlawful recruitment, illegal deployment, illegal subletting, or unauthorised accommodation arrangements;
d. harass, threaten, stalk, abuse, or discriminate against any user;
e. upload malicious code or attempt to interfere with the security or operation of the Platform;
f. scrape, harvest, copy, or extract data from the Platform by automated or manual means for commercial use without our prior written consent;
g. impersonate another person or entity;
h. circumvent any access controls, restrictions, or account limits;
i. use the Platform for any purpose unrelated to legitimate business use in the construction and related sectors, unless expressly allowed by us; or
j. encourage or facilitate any illegal act.

9. No Guarantee; User Due Diligence

CrewPool does not guarantee:

a. that any listing, request, worker, company, equipment, or accommodation is genuine, lawful, available, safe, suitable, or fit for your purpose;
b. that any user will perform, pay, attend, deliver, or comply with agreed terms;
c. that any match, contact, or inquiry will lead to a successful transaction; or
d. that the Platform will always be uninterrupted, error-free, secure, or available.

You are solely responsible for conducting your own due diligence before entering into any arrangement or relying on any information obtained through the Platform.

10. Transactions and Disputes Between Users

Any contract, engagement, booking, lease, subcontract, deployment, accommodation arrangement, or other transaction made between users is solely between those users.

CrewPool is not responsible for and shall not be liable for:

a. unpaid invoices, wages, or fees;
b. project delay, non-performance, defects, or cancellation;
c. on-site injury, death, safety breach, property damage, or loss;
d. illegal deployment, illegal occupancy, or regulatory breach by any user;
e. misrepresentation, fraud, or misconduct by any user; or
f. any dispute between users.

We may, but are not obliged to, assist in communication or moderation. Any such assistance does not make us a party to the dispute.

11. Fees and Future Paid Features

Unless otherwise stated, access to the basic Platform may be free of charge.

We may introduce paid features, subscriptions, listing boosts, lead tools, points, messaging credits, or other monetisation features in the future. If we do, we will present applicable terms, pricing, and payment conditions at that time.

All fees, if any, are non-refundable except where required by law or expressly stated otherwise.

12. Suspension, Restriction, and Termination

We may, at any time and without prior notice where appropriate, suspend, restrict, remove content from, or terminate your account or access to the Platform if:

a. you breach these Terms;
b. we suspect fraud, illegality, abuse, or security risk;
c. we receive a complaint or regulatory request;
d. your use may expose us, other users, or the public to risk; or
e. we decide to discontinue all or part of the Platform.

You may stop using the Platform at any time. You may request account closure by contacting [support email].

Sections that by nature should survive termination will survive, including those relating to liability, indemnity, disputes, and intellectual property.

13. Intellectual Property

The Platform, including its software, branding, text, design, databases, and non-user content, is owned by or licensed to CrewPool and is protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Platform.

14. Privacy

Your use of the Platform is also governed by our Privacy Notice, which forms part of these Terms.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.

We disclaim all warranties, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

16. Limitation of Liability

To the maximum extent permitted by law, CrewPool and its directors, officers, employees, affiliates, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profit, revenue, business, contracts, goodwill, data, or opportunity, arising out of or related to your use of or inability to use the Platform.

To the maximum extent permitted by law, CrewPool’s total aggregate liability arising out of or relating to the Platform or these Terms shall not exceed the greater of:

a. the total amount paid by you to CrewPool in the 3 months preceding the event giving rise to the claim; or
b. SGD 100.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

17. Indemnity

You agree to indemnify and hold harmless CrewPool and its directors, officers, employees, affiliates, contractors, and service providers from and against any claims, actions, proceedings, losses, damages, liabilities, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or related to:

a. your use of the Platform;
b. your User Content;
c. your listings, requests, transactions, or arrangements with other users;
d. your breach of these Terms; or
e. your breach of any law, regulation, permit condition, or third-party right.

18. Changes to the Platform or Terms

We may modify these Terms or the Platform from time to time. Updated Terms will be posted on the Platform with a revised effective date.

Your continued use of the Platform after updated Terms become effective constitutes your acceptance of the updated Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore.

Any dispute arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Singapore, unless we elect in our sole discretion to refer the dispute to arbitration or another dispute resolution process permitted by law.
